SEALING CRIMINAL RECORDS

If you were wrongfully arrested but never prosecuted for a crime, California allows you to seal and eventually destroy all records of the arrest.

When successful all evidence of the arrest including the arrest report, fingerprints, & mugshot will be sealed for a period of three years, then completely destroyed. Once sealed & destroyed, no record of the arrest will appear on any background check and you can legally answer “no” to the question whether you have ever been arrested.

Even if you are innocent and no charges were filed, evidence of the arrest can seriously affect your ability to get a job or subject you to increased scrutiny from law enforcement.
